CWA Fights to Protect Jobs in T-Mobile/MetroPCS Merger

On Monday, CWA asked the Federal Communications Commission (FCC) to protect jobs during the approval process for the T-Mobile-MetroPCS merger. “Clearly, many feel that protecting U.S. jobs is in the public interest,” said CWA Senior Director George Kohl. “The FCC should impose specific conditions protecting T-Mobile employment.”
Click here for a copy of the CWA filing and here for a press release.
CWA has been fighting for jobs at T-Mobile since the company began firing workers in fall 2011 and accelerated the downsizing with the closure of 7 call centers in June that displaced more than 3,300 workers. In its FCC filing, CWA notes with concern that MetroPCS currently outsources all of its customer care, billing, payment processing and logistics operations.

“Wrong and Irresponsible” – The Fake Interview in Der Spiegel

If you remember, a few weeks ago, the German news magazine Der Spiegel published a major review and analysis of the intimidation, harassment and abuse that T-Mobile USA workers have to deal with on a regular basis (Read the article in English here).
Obviously this was a huge embarrassment for T-Mobile USA and its parent company Deutsche Telekom. It appears that the company felt compelled to respond to the serious allegations made in the article and explain its position. Instead of making a statement for the press or talking to a reporter, however, the company decided to take a different route.

Shortly after the article was published, an apparent Spiegel interview with Marion Schick, Deutsche Telekom’s Director of Human Resources, appeared on the company’s intranet.

This is a report from Stephan Heggemann, ver.di activist at Deutsche Telekom in Düsseldorf, Germany, from last week's workers' meeting in Bochum.
Anticipating the general workers' meeting and the related collection of signatures to the petition regarding the MetroPCS merger for our brothers and sisters in the US, we started putting together the ver.di table the night before the meeting and laid out all necessary material.

On November 21, the meeting started, the doors opened and the first bus loads of workers poured into the convention hall. There were coffee and sandwiches and we collected the first signatures. We used every opportunity to collect signatures - before the meeting and during the two breaks.

CWA press release
WASHINGTON, DC – In comments filed today [November 26, 2012] with the Federal Communications Commission (FCC), the Communications Workers of America (CWA) said the proposed joining of T-Mobile USA and MetroPCS presents the FCC with a golden opportunity to preserve and grow jobs here in the United States, jobs that would otherwise continue to head to foreign shores.
“The FCC should impose specific conditions protecting T-Mobile USA employment,” said CWA Senior Director George Kohl. “Otherwise, we’re concerned that T-Mobile and MetroPCS’ identified post-merger ‘efficiencies,’ ‘transaction-specific savings’ and ‘network and non-network synergies’ will once again translate to U.S. job losses. The FCC should make this a ‘growth and opportunity merger’ for U.S. workers too.”

As was widely reported in national news last week, on Black Friday, a wave of historic protests and strikes hit retail giant and notorious union buster Walmart in more than 1,000 stores across the country.
Many T-Mobile workers stood in solidarity with Walmart associates as their problems of injustice on the job, retaliation for union activity and fighting for a voice at work have a familiar ring to them. Here's a photo of our great TU activists in Albuquerque showing their support for the historic Walmart strike.

As we reported, our Facebook action on Thanksgiving was a huge success. Thousands of campaign supporters took action and posted a satyrical video highlighting T-Mobile’s hurtful practice of offshoring call center jobs to T-Mobile's Facebook page. Shortly after 10am, the official start of the action, T-Mobile's Facebook page looked something like this:

But 45 minutes later, most of the posts had disappeared and pretty soon thereafter, T-Mobile ended up closing the comments section altogether. Luckily we took a lot of screenshots of the action and saved a lot of great comments that people posted.

Deutsche Telekom and T-Mobile are feeling the pressure today as news of their employee mistreatment and union busting spreads. On November 18, Der Spiegel, the well-respected German news weekly, released an article detailing the workplace abuses committed by T-Mobile USA and the efforts by both ver.di and CWA to bring justice to workers. The article describes the mistreatment faced by these workers as “brutal psychological terror.”
Click here to read the English translation and here to read the CWA press release.
The story has been picked up by dozens of major German news outlets. Additionally, it’s spreading internationally and is being covered in the UK by Reuters, in the US by the Chicago Tribune, in Austria by Der Standard, in Switzerland by NZZ.

The German news weekly Der Spiegel has just published a major review and analysis of the “brutal psychological terror” faced by workers at T-Mobile USA. Der Spiegel is one of Europe's largest publications with a weekly circulation of more than one million, and it is known for its attention to detail and comprehensive reporting.
Here’s how the article begins:
“The business hotel in Cargo-City South close to the airport in Frankfurt was chosen with caution: the anonymity of the conference rooms provided space for two powerful unionists to meet in private. One of them is Lothar Schröder, Vice Chairman of the Supervisory Board of Deutsche Telekom and Board member of the powerful union ver.di. The other is Larry Cohen, head of the 700,000 member strong American telecommunications union (CWA).
What the two of them concoct in the following two days might be a fairly unique campaign: The organizations are planning to mobilize workers on both sides of the Atlantic in the following weeks, engage the US Congress, Bundestag and ministries and provide the media with sensitive information.

T-Mobile workers all over the country are signing this petition to send a clear message to DT CEO Rene Obermann and T-Mobile CEO John Legere that employees deserve a voice in matters that affect them, and all workers should reap the benefits from this merger instead of fearing for their jobs.

Americans re-elected Barack Obama as president of the United States on Tuesday. Obama’s decisive victory over Mitt Romney proves that Americans prefer a president who will protect workers’ rights, create and keep jobs in the United States, and preserve social security and Medicare.

CWA has fully supported President Obama as an advocate for working Americans. He has promised to support fair wages, and is committed to building a stronger middle class. His actions as president - including saving the American auto industry, supporting equal pay for women, saving and creating more American jobs, and extending Trade Adjustment Assistance - have demonstrated his commitment to workers and his ability to make good on his promises for progressive change in the United States.

Unions from across the globe are joining together in the fight to ensure that workers at all Deutsche Telekom (DT) subsidiaries, including T-Mobile USA, are treated fairly and have a voice on the job. Unions from numerous countries have taken issue with the way DT treats workers and ignores international standards, including its habit of carrying out aggressive campaigns to stifle unions in the United States.
On October 30 -31, 2012, unions from ten countries - Greece, Romania, Bulgaria, Croatia, Bosnia, Montenegro, Czech Republic, Hungary, Germany, and the United States - came together in Athens, Greece for a meeting organized by UNI Global, OME-OTE, the AFL-CIO, and the Friedrich Ebert-Foundation. The meeting was aimed at forming an alliance between unions in countries where DT operates, and to continue the campaign for a Global Agreement between DT and UNI Global that would ensure trade union rights for workers at all DT subsidiaries.

October 7 has become an important date for unions all over the world, fighting for decent work and against union rights violations. At this year’s “World Decent Work Day” conference of the German trade union confederation DGB, more than 200 participants gathered in Berlin. T-Mobile was featured prominently as an example of a German company suppressing essential trade union rights of its non-German workers, particularly those in the US.

DGB president Michael Sommer criticized T-Mobile's parent company, Deutsche Telekom, strongly for its neglect of social partnership and trade union rights in the US.

What does the MetroPCS Deal Mean?

The business press has been saturated with reports yesterday and today of a hook-up between T-Mobile and MetroPCS, the number 5 wireless phone carrier in the U.S. Today Deutsche Telekom officially announced the merger of wholly-owned subsidiary T-Mobile USA and MetroPCS. The combined company will be a publicly listed company, adopt the T-Mobile name, and continue John Legere as CEO.

Undoubtedly, the newly combined company will become a more robust player in the prepaid services business and help T-Mobile recoup some of the customers it lost due to its inability to sell the iPhone. Sprint, which has traditionally been strong in the no-contract services business, walked away from a deal with MetroPCS this year after its Board overruled its CEO. It now faces new challenges and concern from investors about its ability to vie for consumers.
The deal awaits shareholder approval and is still subject to regulatory controls – The Real T-Mobile hopes that the FCC will example local markets for concentration of spectrum – as well as other closing conditions. The merger is expected to close in the first half of 2013.
Here's Legere speaking about the merger in a video the company posted the minute the deal was announced.

T-Mobile cited in New York Times for “family responsibilities discrimination”

That T-Mobile’s self-proclaimed family friendliness is nothing more than smoking mirrors, is a recurring topic on this website.
On September 14th the New York Times carried an article, "When work makes your choose”, about companies discriminating against workers that have family care responsibilities, citing a case at a T-Mobile call center. According to the paper, this type of legally questionable and morally reprehensible behavior is called “family responsibilities discrimination. Given the aging workforce, more workers will face greater challenges. Read the full article here.
This is another example why T-Mobile's commitment to work-life-balance is little more than lip service - and why things at T-Mobile need to change.
On August 20, T-Mobile announced the company's support for Gay Marriage in Washington State. In the press release, Jim Alling, interim CEO and COO states: "T-Mobile has a long-standing focus on creating an inclusive workplace enviornment for our employees."

LGBT organizations like Pride@Work welcome the company's efforts, but wonder why the company is "fighting tooth and nail against their own workers efforts to form a union and have a voice on the job." In a press release from August 24, Pride@Work states that union contracts are a crucial protection vehicle for LGBT workers "that let them support their families with dignity and respect."

US Companies that only a few years ago pocketed millions in taxpayer dollars to establish local call centers are now off-shoring these call center jobs, leaving those communities devastated once again with job losses and lost financial investments. As you know, this year T-Mobile eliminated 3,300 US call center jobs, shipped the work overseas and left thousands of working families worried about the future. Call centers are a major economic force in the United States, representing about three percent of the U.S. workforce.
Watch and share this video to hear directly from T-Mobile and other companies' call center workers who explain why call center jobs are so important to their families and their communities.

CWA supports legislation that would protect US consumers and helps level the playing field against companies that off-shore their call center operations overseas.

On September 3rd, 20 ver.di members protested T-Mobile USA's anti-union stance at Germany's prestigious International Broadcasting Fair IFA in Berlin. Shouting slogans and flashing banners, the protestors caused quite some stir at the exhibition hall of Deutsche Telekom, TM's parent company, before security asked them to leave.
"We think it is not OK that Deutsche Telekom presents a nice facade here at IFA, while our colleagues in the USA lack essential rights,” said Tomas Lenk, ver.di shop steward, adding that US employees face anti-union harassment and intimidation. “It’s because of these things that we join the solidarity campaign: We expect better from Deutsche Telekom."

As we reported six weeks ago, the DoL granted Trade Adjustment Assistance to workers at the seven call centers closed by T-Mobile on June 22. Word has been trickling in that the process has been working for many former T-Mobile employees: the state agencies handling unemployment claims have asked T-Mobile for the addresses of former workers at the call centers, T-Mobile has complied, and the agencies have reached out to displaced workers. According to reports from former T-Mobile workers in Brownsville and Frisco, TX, as well as Allentown, PA, displaced workers have been invited to information sessions to explain TAA benefits. That has been confirmed by conversations with state officials in Kansas, Oregon, and Florida. It is not clear, however, if all eligible workers are being contacted.

On Monday August 20, Senator Bob Casey (D-Pennsylvania) held a press conference in Allentown to promote legislation that would make call center offshoring more difficult. Under Casey’s legislation, “The United States Call Center Worker and Consumer Protection Act,” call center companies that offshore work would be ineligible for federal grants or loans. As Senator Casey stated, “Companies that outsource their call centers overseas shouldn’t see the benefits of government grants and loans…. Keeping call center jobs in the Lehigh Valley is good for our workers and our economy, and passing my bill will send a clear signal that outsourcing jobs will not be rewarded.”

On Saturday, July 28, 2012, the Communications Workers of America and CWA Local 1298 reached agreement with T-Mobile USA on a contract for technicians in Connecticut. This is the first labor agreement in the United States covering T-Mobile workers. Three days later members ratified the contract unanimously.
Agreement on the contract, which will be in effect until May 30, 2014, came after months of negotiations between CWA and the T-Mobile Bargaining Committee. Local 1298 and the Connecticut T-Mobile technicians faced a company that bitterly opposed the workers' successful attempt to form a union and carried that opposition into bargaining a first contract.

We have heard reports from activists around the country that T-Mobile managers may be forcing employees to put charges on customer accounts – both in retail stores and in call centers. Here is a story from Chattanooga, covered by WRBC TV, Channel 3, that looks at retail store practices.According to the report, former T-Mobile employee Temus Terry discovered that charges were put onto customer accounts without the knowledge of the customer. He was fired when he used the employee hotline (aka Integrity Line) to report the incidents.

German Media Covers T-Mobile Offshoring

Three piercing articles have appeared recently in the German press on the topic of offshoring and Trade Adjustment Assistance. The language has been strong - the Department of Labor contradicts T-Mobile, the DoL accuses T-Mobile of lying, T-Mobile is accused of presenting false information to DoL.
This powerful indictment of T-Mobile raises other questions. Why did the company deny the work was offshored? If the company has "long had and does utilize service partners [read outsourcers] both within the U.S. and in other countries, who are they and where are they? Employees and customers want to know.
Finally, Trade Adjustment Assistance can be a powerful tool to help workers transition to new jobs? How did T-Mobile justify the unconscionable denial of offshoring when it knew that such a stance might stand in the way of T-Mobile workers getting the assistance they needed to move on? Luckily, the Department of Labor weighed all the evidence.
